Examination of documents and real estate before purchase

Before purchasing any property, an investor should thoroughly review the documents and the legal status of the property. Only a comprehensive analysis of, inter alia, the developer agreement, land and mortgage registers, and the developer will ensure security to the buyer. Without proper document review, the investor takes a big risk of missing several legal defects of the real estate. From my experience I know that such defects are not rare, especially when it comes to secondary market properties.

Review of a developer agreement

Although the Act on developer development has been in force since 2011, there are still developers on the market willing to bypass its provisions. The use of unlawful clauses, intention to hide the inconvenient facts, potential insolvency of the company (developer) are just some of the problems I face in my work when analyzing the development agreement.

Examination of the land and mortgage register

Checking the legal status of the premises, land and building in the land and mortgage registers is nowadays the basic activity of every real estate lawyer. It is a public record of real estate information. Anyone can access the electronic land and mortgage register via the Ministry of Justice website - just enter the number of the land and mortgage register.

The analysis of the developer’s agreement and review of the land and mortgage register are the basic elements of a diligent pre-purchase real estate check.
